Facts, Findings and Recommendations:
In the review of the aforementioned barangay ordinances, this committee found substantive and procedural flaws or lapses in their enactment, as follow:
- There was a no Public Hearing that was held.
- The enacted barangay ordinances did not reflect as to when it was approved.
- There was no Certification of Posting that was issued.
In view of the foregoing considerations, this committee hereby recommends to return the subject barangay ordinances to Barangay San Agustin for correction.

Subject: From Punong Barangay Milagros M. Reposar furnishing a copy of Barangay Resolution No. 003-Series of 2021 addressed to the Department of Public Works and Highways, for legsilative intervention/inquiry.
Facts, Findings and Recommendations:
Acting on the referral, a committee meeting was held on March 1, 2021 as regards the subject matter. In attendance, likewise were Engr.Zotico Pastelero, Municipal Engineer and Denis Travieza, MDRRM Officer in Charge, who were asked to present their findings of the separate investigations their individual offices had conducted on the collapse structure by the riverbank at Barangay Arado, owned by Mr. Bienvenido Millar Jr. and received a letter of investigation coming from DPWH Region VIII regards with the subject matter.
During the presentation of the reports, Engr. Zotico said that the subject, which is a one storey four bedroom residential building. He likewise mentioned that the wall of the house to the edge of the riverbank , where a proposed revetment by the Department of Public Works and Highways will be, had an original length of twenty (20)meters. After his presentation, he mentioned in the committee that the structure is not livable and to construct a flood control structures and revetment structures.
Then followed the presentation of by Mr. Travieza he mentioned that the house of Bienvenido Millar Jr. collapsed on February 11, 2021 due to the flooding caused by heavy rains and the earth/soil where the house originally stood was washed out that the main contributory factor was the on going construction of a nearby bridge where its underneath support collected debris then clogged the water flow. After his presentation Mr. Travieza recommends that the DPWH / Contractor will construct a river wall and do landfill of the washout properties, reach out to the owner of the property and do necessary help and when there are flooding or increased water volume in the river DPWH / Contractor will be ready to intervene when debris under the bridge will clog the water ways.
Received letter of investigation coming from the DPWH Region VIII, during the inspection dated February 22, 2021 they have noticed various debris trapped under the bridge carried by the flow of strong current that caused severe scouring brought by excessive flood waters, initiating soil erosion in the area including the backfilled area of the approach slab of the bridge and the prepared footing of the 2-Piers ready for pouring were washed out and steel sheet piles used for shoring were misaligned.
The above mentioned Project Engineers report was referred to the Planning and Design Division for further assessment and possible funding for the repair of the said calamity related damage and recommend for the construction of revetment structure at the bangon river specifically along Barangay Arado Palo, Leyte and to contruct necessary flood control structures.
In view of the forgoing considerations, this committee hereby recommends to let DPWH finish the ongoing construction of the bridge and also to construct a flood control structure.
